A revocable living trust has many benefits and using the right attorney to work with you in creating your trust is very important. Some benefits to a revocable living trust are:
Avoiding Probate: A Last Will and testament does not avoid probate; in fact, probate includes the validation of the Will. A revocable living trust, however, is designed to avoid the cost and time-consuming nature of probate.
Privacy: A revocable living trust can keep your matters confidential. A last will and testament, however, is probated and is subject to the disclosures required during the probate process becoming part of the public record.
Asset Management: If you become incapacitated, you can name an alternate trustee to take over management of the trust assets.
Avoid Delays in Distribution: Probate can be a time-consuming process. A trustee of a revocable living trust can distribute to your loved ones much faster a will goes through probate.
Emma takes a hands-on approach to helping you set up your revocable living trust. The biggest issue with trusts is that they are not funded correctly. Emma provides detailed instructions on each asset – including the pros and cons of putting it into the revocable living trust and telling you how change the ownership to the trust.
Emma does everything she can to keep her prices affordable, and even publishes estimated prices online.
The process starts with a very short (15-30 min) phone consultation to review the very basic information regarding your last will and testament to ensure that Emma is the right attorney to handle your estate.
You will give Emma your specific instructions through filling out a provided worksheet. Emma is available to help you fill in this worksheet if needed either by telephone, video conference, or an in-person consultation.
Emma drafts your revocable living trust with other documents. This usually takes about a week, but Emma will give you an estimated draft by date either during your initial consultation or once you have hired her.
Every revocable living trust that Emma drafts includes up to 2 hours of attorney time to revise and correct the trust. You can set up a meeting to review the documents with Emma if needed.
Emma will provide 2 witnesses and a notary to be present for the signing. If you choose to do the signing on your own, Emma will provide instructions.
